The Power of the Paper Trail – How to Use Prior Written Notice (PWN)

One of the most frequent friction points for parents occurs when a district administrator or coordinator verbally denies a request. Whether you are asking for an independent evaluation, a specific assistive technology tool, or an out-of-district specialized placement, a verbal "We can't do that" or "That's not sustainable" often shuts the conversation down entirely.

Verbal denials are easy for a bureaucracy because they leave no paper trail. However, federal law provides parents with a powerful mechanism to combat this: Prior Written Notice (PWN).

What is Prior Written Notice?

Under the Individuals with Disabilities Education Act (IDEA)—specifically 20 U.S.C. § 1415(c)—a school district is legally required to provide parents with a formal, written notice whenever the school proposes to change, or refuses to change, a child's:

  • Identification (diagnosis/eligibility)

  • Evaluation

  • Educational placement

  • Provision of a Free Appropriate Public Education (FAPE)

A legally compliant PWN cannot just be a simple "no" email. By law, it must explicitly document:

  1. Exactly what the school is refusing to do.

  2. The precise explanation of why the school is refusing.

  3. A description of each evaluation procedure, assessment, record, or report the team used as the basis for the refusal.

Changing the Dynamic

When a district gatekeeper says "no" verbally, your response should be calm, professional, and unyielding. You do not need to argue. You simply shift the burden of documentation entirely back onto the institution:

  • “I understand the district is declining this request. To ensure my records are complete, I am formally requesting a Prior Written Notice (PWN) detailing this refusal, along with the specific evaluation data the team used to determine this service is not required.”

Districts are highly reluctant to put resource limitations or administrative convenience into a formal PWN, because doing so creates an immediate, actionable target for a state compliance complaint. By professionally demanding a PWN, you ensure the adults in the room step out of analysis paralysis and move toward accountable decision-making.
